Know More About Intellectual Property Attorney

As we see on movies, every lawyer is not running to trail every day to win a new case. Every lawyer will be specialized in certain areas and work in both legal and non legal capacities. For several years the hottest practice group has been intellectual property law. But the real fact is that, most of the attorneys doesn't even know what intellectual property law is. Have you heard about a term intellectual property? Tangible and intangible works of a human mind constitutes intellectual property. IP or intellectual property refers to the creations of mind. So, it is produced by artists, business corporations, inventors etc. An intellectual property lawyer assists the client in creating, identifying, protecting, transferring and licensing the IP.

Unless and until an attorney practice intellectual law, he or she will not be having a better idea about it. Still being the hottest practice area in United States, there are confusions about what it actually means to be an intellectual property lawyer. According to the real property (land) right, the owner has the right to posses it and prevent others from possessing it. On the other hand, for an intellectual property which doesn't have a physical form including names and logos of products and inventions etc must also have a law to protect the use and reproduce.

For practicing as an intellectual property attorney, a degree from an accredited law school is necessary. Traditionally they are specialized in four areas of law say patent law, copyright law, trademark law and trade secret law. A patent is the right to prevent others from producing, using or selling any of your inventions without your concern. It protects a person's exclusive right on his discoveries or inventions. For protecting the tangible works of a client like authorship on musical, artistic or dramatic works and computer software, the copyright law was introduced. It lasts for a person's lifetime plus 50 years. The third basic form of IP law is trademark law. It is to protect the brand name of a company. It also protects the symbol or logo of a company's product or service. Some producers try to trick the consumers by using names similar to other product which has high demand in the market. For preventing this from happening, trademark law came into existence. Its protection lasts for 10 years after registration and can be renewed if needed. From the name itself it is understood that, trade secret law is to protect a company's secret of success. It could be a formula, pattern or device used for making any successful product which will make them stay good in the market. After the completion of the law degree, a lot many options are available for a student to get practiced as an intellectual property attorney. In most of the law firms, he or she will be hired as a junior associate. From there, he or she can move to senior associate position after gaining good experience in the field.
